Squirrel Media Webhosting strives to provide the best possible service to all our customers, but we will not tolerate any unlawful activity or abuse on our servers. We respect freedom of speech and expression unless it is harmful to others. These Terms and Conditions are strictly enforced to protect you, other Squirrel Webhosting customers and Squirrel Media Web Hosts

Quotations are free of charge and you are under no obligation, until the quote is accepted by you in writing (email is fine). By accepting the quote, you have agreed to the terms and conditions as outlined here. Quotations are valid for 14 days. Costs on quotations are not binding

Full payment is due on the first day of your hosting account activation.  You will  then receive an invoice no later than the 15th of the month for which payment is due. Billing will continue until you cancel your hosting account. Payment is only possible by EFT (internet banking), debit order, or by credit card (Payfast).

Cash payments and cheque deposits attract a bank charge of R50 which will be passed on to any client making payment by cash or cheque deposit.

Domain registration fees, VPS rental and setup fees, backup fees, software installation fees and deposits for website design work are not refundable under any circumstances, for any reason whatsoever. Domain renewal fees are subject to change without notice.

If you have received a free domain through a Squirrel Media Webhosting promotion, then the registration fees for that domain are payable in full if you cancel your hosting account before 12 months have passed.

Late payment will result in the suspension of your hosting account, and a reconnection fee of R100 may be levied. Clients who regularly make late payments may be required to sign a debit order mandate allowing Squirrel Media Webhosting to debit their bank account or credit card.

Shared hosting accounts will be suspended if they are still unpaid 3 days after the due date and terminated after 7 days of non-payment. If an account needs to be restored from backup after termination, a data recovery fee of R250 will be levied.

"Unpaid" means that the funds do not reflect in our bank account.

Servers will be terminated on the first day of the month, if payment is not received by the last day of the preceding month. It is not possible to restore a server which has been terminated.

You may cancel your hosting services at any time in your client area. No refunds or pro-rata refunds will be given, under any circumstances.
All data from your hosting account will be deleted once your account has been cancelled.
• Your new hosting company will be able to move your email accounts across including any emails saved on the server.
• The domain will only be transferred if your hosting account is up to date

When necessary, usually in cases of spam and server abuse, Squirrel Media Webhosting reserves the right to terminate a hosting account at any time, for any reason, ( which reason may or may not be provided at our sole discretion).

If an account is terminated, the balance of any hosting fees will not be refunded. If an account is terminated, it will not be possible to access any files or emails which were stored on the server at the time of termination. For this reason it is important that you make use of the tools provided in your control panel to make regular backups of your hosting account(s).

• Squirrel Media offers a best effort service and can guarantee an uptime of 99.99 percent. It is therefore the responsibility of the client to ensure they perform backup of their hosting account.
• Standard Hosting accounts do not include website support. Please enquire with our Sales team about this option.

You agree to use all Squirrel Media Webhosting services and facilities at your own risk. Squirrel Media Webhosting specifically disclaims all warranties of merchantability and fitness for a particular purpose.

In no event shall Squirrel Media Webhosting be liable for any loss, or loss of data either stored on our servers or stored as backups or accessed via remote support on your local hardware or devices, or other commercial damage, including but not limited to special, incidental, consequential or other damages.

You agree that you shall defend, indemnify, save and hold Squirrel Media Webhosting harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against Squirrel Media its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by you, your agents, employees or assigns.

You agree to defend, indemnify and hold harmless Squirrel Media Webhosting against liabilities arising out of:

– Any injury to person or property caused by any products sold or otherwise distributed in connection with Squirrel Media ’s server;
– Any material supplied by you infringing or allegedly infringing on the proprietary rights of a third party;
– Copyright infringement;
– Any defective products sold to customers from Squirrel Media ’s server.

Squirrel Media Webhosting shall be the sole judge of what violates this Policy.

If we determine that any site on our servers is using too much of the server’s resources and therefore abusing the server, we have the right to suspend that domain without any notice. It is then up to you to contact us and formulate a plan to get that domain activated again.

We are quick to suspend any domain that abuses the server’s resources due to the shared nature of the server and the negative impact an abusing domain has on other domains on the same server.

We do not allow mass email marketing sites on our servers and no mass emailing of any kind whatsoever, including email newsletters, is allowed on our network. It doesn’t matter if it’s “opt-in email marketing”, we simply do not allow sites of that nature to be hosted on our network. Sites such as “safe lists” and “free email” are also strictly prohibited. We reserve the right to shutdown such sites without prior notice.

Squirrel Media Webhosting has a zero-tolerance, anti-Spamming policy. Under this policy, we prohibit Spam, or any unsolicited commercial email, from being sent either:

– over the Squirrel Media Webhosting network, by customers or any other users of the Squirrel Media Webhosting network;
– and/or over any network if the message sent advertises or mentions a site hosted on a Squirrel Media Webhosting server.

We react quickly and seriously to violations, and we further reserve the right to suspend or terminate the services, without prior notice, of any customer disregarding this policy.

If spam sent through your account results in a mailserver being blacklisted, we reserve the right to charge you for any blacklist removal fees that may be incurred.

Sending unsolicited commercial email (a.k.a. “spam”), cross-posting messages to a large number of Usenet groups, posting obscene or threatening messages while using or referring to an Squirrel Media Webhosting email address or web site URL is prohibited.

The use of Squirrel Media Webhosting servers as a mail drop for responses to activities described above is also prohibited.

If your hosting account is involved in spamming activities, and your account is subsequently terminated, then you do not have the right to a refund. This also includes refunds for additional services or products, such as installations of software, SSL certificates and dedicated IP addresses purchased for that hosting account.

All services provided by Squirrel Media Webhosting may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any South African, Swiss, United Kingdom or United States Federal, State, Provincial or City law is prohibited.
This includes, but is not limited to: copyrighted material, trademark, intellectual property, material we judge to be threatening or obscene, or material protected by trade secret and other statute without proper authorization.
The subscriber agrees to indemnify and hold harmless Squirrel Media Webhosting from any claims resulting from the use of the service which damages the subscriber or any other party.
Sites that promote any illegal activity or present content that may be damaging to Squirrel Media Webhosting servers or any other server on the internet are prohibited. Links to such materials are also prohibited.

Examples of unacceptable content or links:

– Pirated software
– Hacker programs or archives
– Warez sites
– Online gambling

Squirrel Media Webhosting does not allow the hosting of web pages, links or content of any nature whatsoever which promotes or links to the websites of its competitors.
Any illegal activity, online gambling, spamming or hacking will result in your site being shut down.
Squirrel Media Webhosting will be the sole arbiter as to what constitutes a violation of this provision.

The disk space allocated to hosting account may only be used to store the files required to display and manage your website and its content, and emails for up to 30 days. Squirrel Media Webhosting reserves the right to delete any files (such as backups) stored in your hosting account and not required for the operation of your website, and all emails older than 30 days, without notice.

Bandwidth overages (the amount of bandwidth used in excess of the amount allowed by your hosting account) are charged at R8.00 per GB plus VAT.

You are free to install and use any scripts you wish, (as long as they are not on our banned scripts list, see below) however we reserve the right to disable any script or software in your hosting account that affects normal server operation or service to other Squirrel Media Webhosting customers.
Squirrel Media Webhosting is not responsible for any scripts or software that you use in your hosting. It is not our responsibility to ensure your scripts or software functions correctly. Please don’t expect our support techs to troubleshoot aspects of the scripts or software that you use on your sites hosted on our servers.
Squirrel Media Webhosting provides technical support for the Server & Server related softwares. Any scripts included in your Control Panel for use or installation are 3rd Party scripts and are not supported by Squirrel Media , however you may ask for assistance (which we are usually willing and able to give) by submitting a support ticket.

If we find banned scripts active in your account, we will suspend your account and disable or remove the offending script and send you an email notifying you of our actions.

As part of the management service of WordPress MAX hosting, we reserve the right to modify, delete, deactivate or replace any plugin which is hacked, abandoned by its developer or which causes performance issues on the server, without notice.

Any breach of these terms will result in the suspension of your WordPress MAX account and we reserve the right to charge for the time taken to re-install plugins and reconfigure your WP MAX account to the correct settings.

Refusal of Service
We reserve the right to refuse service to anyone for any reason not prohibited by law. We reserve the right to terminate service to any customer for any reason not prohibited by law.
Any deliberate attempt to cause damage to Squirrel Media ’s servers, the Squirrel Media Webhosting network or any other internet servers will result in immediate account deactivation without prior notice. No refund is given in this case.

Free Domain Promotions
When using a promotional code for a free domain bundled with a new hosting account, the domain is free if the hosting is kept active for a minimum of 12 months. If the hosting account is cancelled before then, the domain registration fee becomes payable for the domain.

Full server backups are made weekly, excluding emails which are never backed up. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for server restoration purposes only. It is the client’s responsibility to maintain local copies of their website’s files, databases and other content or to make use of our Automated Backup service.

It is the client’s responsibility to have a good working knowledge of aspects of their site’s operation. Please do not expect the Squirrel Media Webhosting support staff to teach you how to use aspects of the tools at your disposal, and especially not the software (such as email and FTP clients) which you have installed and run on your own PC.

• Squirrel Media cannot and will not be held responsible for any loss of data on any clients hosting account should they opt to use another web developer other than Squirrel media Web Designers.
• Any additional work such as pages or features that are not included in the quote, will be charged for separately. Squirrel Media will inform the client of the additional costs before the work is done.

Payments: We require a 50% deposit before any work can begin. Once quote is accepted, we will forward the invoice for the deposit. Payment of the deposit signifies that the terms herein have been read and accepted. The deposit is only refundable if no work has been conducted. If work has been done on the project and a refund be requested before completion, Squirrel Media will refund a percentage of the amount paid based on the hours spent on the project.
Once the deposit has been paid, we require all information to be provided to us by the client. Only once we have received all content, can we commence with the project.
• A Maximum of 4 sections per page thereafter a fee of R250 per section will be billed to you.
• Monthly payments are required to be paid by the 30th of each month. failure to pay these amounts will result in a suspension of services.
• We reserve the right to suspend your services if no payment is received 45 days after due date. Your Website & emails will be affected by this.
• We reserve the right to terminate (delete) all content if no payment is received within 60 days of due date of your last invoice.
Only once full payment has been received, your account will be reactivated.

Timeline and Revisions: Projects that are put on held in account of the client for more than 30 calendar days will be invoiced according to the work already done on the project. We will continue to work on the project once the client is ready.
Should the client be unable to provide all information and content that is needed to fully complete the project and go live, Squirrel Media will invoice the client 40% of the outstanding invoice amount. The remainder 10% will be invoiced when we are ready to go live with the website.
Information/Content must be provided in word/text format and supplied to us electronically, this includes your logo and any other image material you wish for us to include on your website.
The completion date of the project will be influenced by retrieval of content, feedback and website changes. Timelines will be adjusted accordingly.
You’ll review our work, provide feedback and approval in a timely manner, we allow for 10 hours changes once the design has been approved. Should we exceed the allocated time, we will invoice hourly at a rate of R550.00 per hour. Deadlines work two ways, so you’ll also be bound by dates we set together.
Changes must be requested in writing (via email).
When everything goes as planned, the original timeline should be met. This is the best case scenario and should happen more times than not
If there are changes to the original scope, this would mean more work, and at the very least they require re-direction and further planning – This will extend the original timeline given.
Timelines given are purely estimates. With almost every project there are circumstances you can’t plan for. For example, some seemingly simple items may create certain roadblocks or require more analysis and development than expected.
Meeting timelines will also depend on the client. The more time the client takes to provide feedback, changes or approval, the less time there is to do the work.

While every attempt will be made to ensure that the website and any scripts or programs are free of errors and conflicts, Squirrel Media cannot agree to take accountability for any losses that may incur due to malfunction of the website. The client will have full responsibility to ensure that all software is functioning correctly before use.

• Squirrel Media cannot and will not be held responsible for any loss of data on any clients hosting account should they opt to use another web developer other than Squirrel media Web Designers. 
• Any additional work such as pages or features that are not included in the quote, will be charged for separately. Squirrel Media will inform the client of the additional costs before the work is done.

• Once your website is live on the web, Squirrel Media will provide a 30-calendar day window to test the website for any problems/bugs to the software or files that was invoiced on. After this 30-day period, any further changes or updates to software will be charged for.
There are constant improvements being made to core and security files with WordPress. For this reason, it is important to keep all plugins/WordPress files up to date. We offer maintenance packages which includes keeping all files up to date.
